OTOEKO TİCARET LİMİTED ŞİRKETİ
MEMBERSHIP AGREEMENT
Parties
This Agreement has been concluded electronically between OTOEKO TİCARET LİMİTED ŞİRKETİ established in Antalya (hereinafter referred to as "OTOEKO" or "Company") and the person who becomes a member on the platform (hereinafter referred to as "MEMBER").
Definitions
Subject of the Agreement
The subject of this Agreement is to determine the terms of use of all content and services offered on the platform and the mutual rights and obligations of the parties.
Rights and Obligations of Members
- Basic membership is free unless otherwise stated. Membership is personal and non-transferable.
- You must be 18 years of age or older and have the capacity to discern to become a member.
- The member is obliged to protect their username and password. OTOEKO is not responsible for problems arising from unauthorized use.
- The member cannot share content contrary to laws and general morality on the platform, cannot violate copyrights.
- The member cannot compete with the Company or engage in behavior that damages the commercial reputation of the company or third parties.
- OTOEKO is not responsible for defects in products and services purchased by members.
- The member can only operate on the platform for legal purposes and is responsible for all their transactions.
- The accuracy of products/services/content accessed through the Platform is not guaranteed by OTOEKO.
Rights and Responsibilities of OTOEKO
- OTOEKO reserves the right to change the services and content on the platform without any notice.
- OTOEKO has the right to cancel membership without any warning.
- Personal information will be kept confidential and processed in accordance with the Personal Data Protection Law No. 6698.
- OTOEKO cannot be held responsible for service interruption, technical failures, cyber attacks, theft, destruction, etc.
- OTOEKO is not responsible for content shared by members.
- OTOEKO may use cookies and similar technologies to measure the success rate of all advertisements and promotions on the platform.
Disciplinary Action / Account Termination
OTOEKO may suspend, terminate or block access to the platform in whole or in part, or any Member account, at any time and with or without cause, without any notice.
Intellectual Property Rights
The design, content and all elements of the Platform belong to OTOEKO and are protected under the Law on Intellectual and Artistic Works No. 5846 and the Industrial Property Law No. 6769. Unauthorized use, copying or distribution is prohibited.
Applicable Law and Dispute Resolution
This Agreement is subject to the laws of the Republic of Turkey. Antalya (Muratpaşa) Courts and Execution Offices are authorized for disputes arising from the Agreement.
Duration and Termination of the Agreement
This Agreement remains in force until membership ends. The member can terminate their membership at any time. OTOEKO can also terminate membership in case of violation of rules.
PERSONAL DATA PROTECTION AND PROCESSING POLICY
Data Controller
In accordance with KVKK No. 6698, your personal data may be processed by OTOEKO TİCARET LİMİTED ŞİRKETİ as the data controller within the scope explained below.
Processed Personal Data
The following categories of your personal data may be processed when using our platform or purchasing products/services:

Considering our main business of diagnostic equipment sales, special categories of personal data (race, ethnicity, political opinion, philosophical belief, religion, sect, health, sexual life, biometric and genetic data) are not processed by us.

Collection Methods
Information you directly share by filling out membership registration forms, order forms, contact forms, sending emails, calling our call center or visiting our store.
Information automatically collected through the technical infrastructure, systems and software used during your platform visit.
Information obtained indirectly from sources such as business partners, payment service providers, cargo companies.
Legal Reasons
Data necessary for the fulfillment of our contractual obligations such as processing your order, delivering your products, receiving payment.
Data required for the fulfillment of legal obligations such as invoicing, tax legislation, consumer rights.
Data necessary for our legitimate interests such as ensuring platform security, fraud detection, improving service quality.
Purposes of Processing Your Personal Data
Your personal data is processed for the following purposes:
- Creating and managing your membership account
- Receiving, preparing and tracking your orders
- Delivery of products purchased (diagnostic devices, software, cables, etc.)
- Receiving payments and conducting financial transactions
- Issuing legal documents (invoice, waybill, etc.)
- Providing after-sales support services
- Managing return, exchange or order cancellation requests
- Informing about order status, cargo information, etc.
- Receiving and evaluating requests, questions, complaints and suggestions
- Conducting surveys to measure customer satisfaction
- Conducting customer relationship management activities
- Sending campaign, discount, promotion information
- Analyzing your shopping habits and providing personalized content
- Displaying targeted advertisements
- Fulfillment of obligations arising from legislation
- Responding to information requests from authorized institutions
- Ensuring information security and preventing unauthorized access
- Detection and prevention of fraud and other illegal activities
- Exercising the right of defense in possible legal disputes
Transfer of Your Personal Data
Your personal data may be transferred to the following recipient groups for the realization of the above-mentioned purposes, in accordance with Articles 8 and 9 of KVKK, with necessary security measures:

Official authorities such as courts, prosecutors, police, ministries, regulatory bodies
In some cases, your personal data may be transferred abroad through the information systems and service providers we use. These transfers are carried out in accordance with the conditions regulated in Article 9 of KVKK.

Your Rights as Data Subject
Pursuant to Article 11 of KVKK, you have the following rights by applying to our Company as the data controller:
- To learn whether your personal data is being processed
- To request information if your personal data has been processed
- To learn the purpose of processing personal data and whether they are used in accordance with their purpose
- To know the third parties to whom personal data is transferred domestically or abroad
- To request correction of personal data if processed incompletely or incorrectly
- To request deletion or destruction of personal data under Article 7 of KVKK
- To request notification of correction/deletion to third parties to whom data has been transferred
- To object to any result against you arising from analysis exclusively by automated systems
- To claim compensation if you suffer damage due to unlawful processing

This Privacy Policy may be updated due to changes in current legislation, Board decisions or changes in our Company's data processing purposes and methods.
